611612014 State.co.us Executi\,e Branch Mail - Fwd: letter to Daee Berry and copied to other staff-
Please forward to staff.
As we discussed earlier this week I am seeking information regarding the corporate structure of K2T as it
relates to standing and their ability to intervene in the NOV and request for a hearing before the Board.
In particular, I am interested in any information that staff has acquired (either through independent
research or from Energy Fuels or the interested parties themselves) that relates to who has been
designated as the agent /representative of K2T. This is important to ensure that DRMS and the Board are
corresponding with the appropriate agent /person who has been authorized to represent and bind the
corporate entity. It is also important to ensure that DRMS is negotiating settlement with a designated
agent. Although DRMS has been working with Ms. Saunders it is not clear if she is purporting to represent
K2T as an entity, and if so, has K2T authorized her to act on its behalf.
I will start my own research into this matter but rather than re- create research I thought staff may already
have some relevant information on this.
Thanks, and please call if you have any additional questions.
Jeff
Jeff M.
