January 13, 2015 C- 2010- 089/New Horizon North Mine BFB <br />The cross sections of the NHN 001 ditches were surveyed by Trevor Ragsdale of WFC using a Trimble GPS <br />(photo 2). The survey was taken at the request of WFC because they felt the measurements taken by DRMS with <br />a tape measure in December were not accurate enough. The results of the survey are attached at the end of this <br />report. DRMS and WFC are currently discussing the results to determine if the ditch segments are in compliance <br />with the permit. The NOV abatement date has been extended to February 27, 2015. <br />The ditch lining material Geo -Web was installed higher on the ditch banks in segment 7 of the NHN 001 ditch <br />(photo 2). Geo -Web was also installed in east segment 1 from 4 +68 to 5 +25 (approximately) and in east segment <br />2 from 7 +70 to 8 +75 (approximately) where it was noted as missing in the last inspection report. The sediment <br />deposit noted in segment 3 of the same ditch had been removed. <br />The Geo -Web in several areas of NHN 001 west segment 3 ditch has slumped between the tie -down pins. The <br />slumped Geo -Web needs to be repaired. <br />Pond 2 was being constructed. Two scrapers and a bulldozer were removing the soil from the pond area and <br />hauling it to the main overburden stockpile (photo 3). The embankment and outfall area was staked out (photo 4). <br />The distance from Nygren Draw to ditch NHN 001 east segments was measured at 85 feet. WFC feels that <br />Nygren Draw is an ephemeral stream with a drainage area less than 1 square mile and does not warrant stream <br />buffer zone protection (Rule 4.05.18). WFC will be submitting evidence that Nygren Draw meets this criterion. <br />ROADS — Rule 4.03 <br />Construction 4.03.1(3)/4.03.2(3), Drainage 4.03.1(4)/4.03.2(4), Surfacing and Maintenance4.03.1(5) and <br />(6)/4.03.2(5) and (6), Reclamation 4.03.1(7)/4.03.2(7): <br />The east entrance road used by the coal haul trucks was well maintained and passable. The road north of <br />Pond NHN 001 was very muddy. <br />SIGNS AND MARKERS — Rule 4.02: <br />The topsoil was stripped and salvaged on the south side of Meehan Draw. The stream buffer zones signs <br />were in place and measured during this inspection to be at least 100 feet from the stream.
