Box 33695 <br />Denver, CO 80233 -0695 <br />RE: New Horizon North Mine, Permit No. C- 2010 -089 <br />2013 Annual Reclamation Report Review <br />Dear Mr. Gilbreath: <br />The Division of Reclamation Mining and Safety (Division) has reviewed the 2013 Annual Reclamation Report <br />(ARR) for the New Horizon North Mine. The ARR requirements are found in Rule 2.04.13 of the Regulations <br />of the Colorado Mined Land Reclamation Board for Coal Mining. The Division has the following comments <br />and questions about the 2013 ARR: <br />1. Maps 2013 -1 thru -6 are labeled as the New Horizon Mine. Please correct the labeling to prevent <br />confusion with the New Horizon 2 Mine. <br />2. The NHN permit boundary line on Map 2013 -1 is not visible. Also, the northern permit boundary for <br />the New Horizon 2 boundary is incorrect. <br />3. On page 3 of the ARR, it states that "all [Garvey] Progresso soil classifications are salvaged and either <br />stockpiled separately or re- applied back to the same general area as it is salvaged from." This statement <br />is contradictory to the NHN Permit (Section 2.05.4(2)(d) page 13) which explains that Garvey <br />Progresso soils east of the Second Park Lateral Ditch will be relocated to the west of the ditch and the <br />78 PIN soils west of the ditch will be relocated to the east of the ditch. This is to enhance the potential <br />productivity of the proposed Intensively Managed Irrigated Pasture.
