1/22/2015 State.co.us Executive Branch Mail - FW: Underground Bore Hole Mining and UIC Class III Well Permit <br />In response to your request to document our phone conversation January 20, 2015 about the proposed Black <br />Range Minerals mining operation in Freemont County, Colorado I am sending this email addressing the major <br />points of the conversation. <br />1. If Black Range Minerals proposes a mining method using injection to recover minerals it would require an <br />underground injection control (UIC) permit. The State of Colorado only has primacy for Class II injection wells <br />associated with oil and gas disposal. Therefore, if the proposed injection would be classified under any other UIC <br />well class, EPA would be the permitting agency. <br />2. Once the EPA receives and reviews a permit application, a determination would be made as to whether or <br />not an aquifer exemption is needed in conjunction with the application. <br />3.
