PERMIT #: M- 2014 -064 <br />INSPECTOR'S INITIALS: ECS <br />INSPECTION DATE: January 20, 2015 <br />OBSERVATIONS <br />This is a pre - operational inspection of the proposed VanCleve Pit conducted by Eric Scott of DRMS. DRMS met <br />with permittee representative Mike Asmus and property owner Colby VanCleve at approximately 11:00 AM <br />and toured the proposed site with them. The site access road from County Road 104 has not yet been <br />improved, so the site was accessed through the VanCleve ranch from the west. The required notice and <br />permit boundary markers were in place at the time of the inspection (see attached photos). <br />Two issues were noted during this preoperational inspection that will need to be addressed before the permit <br />application can be approved by the Division: <br />1) The NW corner of the proposed permit boundary ( #1 as shown on the attached map) as marked in the <br />field is only 34 feet from a new gas pipeline that has recently been installed through the area. The <br />permittee will need to obtain a damage waiver structure agreement from the owner of the pipeline, or <br />commit to mining no closer than 200' from the pipeline location as an enforceable condition of the <br />permit. <br />2) DRMS collected GPS locations for all permit boundary markers during this inspection. As marked, the <br />permit area, not including the access road, is slightly less than the area stated in the submitted <br />application (98.4 acres marked vs. 100.6 acres on the application). Although there may be some slight <br />error due to the accuracy of the GPS coordinates, comparison of the GPS located points to the <br />submitted permit boundary map seems to indicate that markers #5 and #10 may be slightly misplaced <br />in the field. Because the acreage marked will be slightly less than the permitted acreage, the permittee <br />may maintain the boundary as marked if they wish. If the permittee wishes to adjust the boundary <br />markers to encompass the entire 100.6 acres shown on the permit boundary map as submitted, DRMS <br />will require that the GPS locations for moved markers be recollected for verification. <br />Please provide DRMS with your responses to these two adequacy issues prior to the decision date for this <br />application.
