January 22, 2015 Page 4 Conditions of Approval I hereby approve the substitute water supply plan in accordance with Section 37 -90- 137(11), C.R.S., subject to the following conditions: 1. This SWSP shall be valid for the period of October 17, 2014 through April 30, 2015, unless otherwise revoked, modified, or superceded by decree. The plan will be extended until September 30, 2015 if a new lease with the Central Colorado Water Conservancy District or other entity that will provide replacement water from MWWTP is submitted to this office by April 30, 2015. If this plan will not be made absolute by a water court action by the plan's expiration date, a renewal request must be submitted to this office by March 15, 2015 or August 15, 2015 (if the expiration date is extended until September 30, 2015). 2. Well permit no. 43446 -F was issued for the Sandy Acres Pit, however this permit covers only 20 acres of exposed ground water. Therefore, a well new permit must be obtained for the current use and exposed surface area of the,gravel pit pond(s) in accordance with X37 -90- 137(2) and (11), C.R.S. in conjunction with this plan. Application receipt no. 3666997 submitted to this office with the SWSP request is pending evaluation. The provisions of Colorado Revised Statute 37 -90- 137(2) prohibits the issuance of a permit for a well to be located within 600 feet of any existing well, unless the State Engineer finds that circumstances so warrant after a hearing held in accordance with the procedural rules in 2CCR402 -5. This hearing may be waived if you are able to obtain statements from the owners of all wells within 600 feet, verifying that they have no objection to your use of the proposed well. Should a new well permit be denied for reasons of 600 foot spacing, or any other legitimate reason, approval of this SWSP may be cancelled. 3. The total surface area of exposed ground water at the Sandy Acres Pit shall not exceed 33.02 acres, resulting in an annual evaporative loss of 90.72 acre -feet. 4. Total consumption at the Sandy Acres Pit must not exceed the aforementioned amounts unless an amendment is made to this plan. 5. Approval of this plan is for the purposes as stated herein. Any additional uses of this water must first be approved by this office. 6. All releases of replacement water must be sufficient to cover all out -of- priority depletions in time, place, and amount and must be made under the direction and /or the approval of the water commissioner. The release of replacement water may be aggregated to maximize beneficial use if approved by the water commissioner or division engineer. The water commissioner and /or the division engineer shall determine the rate and timing of an aggregated release. 7. Conveyance loss for delivery of augmentation water is subject to assessment and modification as determined by the division engineer. The applicant must provide 72
