E. <br />January 22, 2015 <br />Page 4 <br />Conditions of Approval <br />I hereby approve the substitute water supply plan in accordance with Section 37 -90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of October 17, 2014 through April 30, 2015, <br />unless otherwise revoked, modified, or superceded by decree. The plan will be <br />extended until September 30, 2015 if a new lease with the Central Colorado <br />Water Conservancy District or other entity that will provide replacement water <br />from MWWTP is submitted to this office by April 30, 2015. If this plan will not be <br />made absolute by a water court action by the plan's expiration date, a renewal <br />request must be submitted to this office by March 15, 2015 or August 15, 2015 (if <br />the expiration date is extended until September 30, 2015). <br />2. Well permit no. 43446 -F was issued for the Sandy Acres Pit, however this permit <br />covers only 20 acres of exposed ground water. Therefore, a well new permit must <br />be obtained for the current use and exposed surface area of the,gravel pit pond(s) in <br />accordance with X37 -90- 137(2) and (11), C.R.S. in conjunction with this plan. <br />Application receipt no. 3666997 submitted to this office with the SWSP request is <br />pending evaluation. The provisions of Colorado Revised Statute 37 -90- 137(2) prohibits <br />the issuance of a permit for a well to be located within 600 feet of any existing well, <br />unless the State Engineer finds that circumstances so warrant after a hearing held in <br />accordance with the procedural rules in 2CCR402 -5. This hearing may be waived if you <br />are able to obtain statements from the owners of all wells within 600 feet, verifying <br />that they have no objection to your use of the proposed well. Should a new well permit <br />be denied for reasons of 600 foot spacing, or any other legitimate reason, approval of <br />this SWSP may be cancelled. <br />3. The total surface area of exposed ground water at the Sandy Acres Pit shall not <br />exceed 33.02 acres, resulting in an annual evaporative loss of 90.72 acre -feet. <br />4. Total consumption at the Sandy Acres Pit must not exceed the aforementioned <br />amounts unless an amendment is made to this plan. <br />5. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. <br />6. All releases of replacement water must be sufficient to cover all out -of- priority <br />depletions in time, place, and amount and must be made under the direction and /or <br />the approval of the water commissioner. The release of replacement water may be <br />aggregated to maximize beneficial use if approved by the water commissioner or <br />division engineer. The water commissioner and /or the division engineer shall <br />determine the rate and timing of an aggregated release. <br />7. Conveyance loss for delivery of augmentation water is subject to assessment and <br />modification as determined by the division engineer. The applicant must provide 72 <br />
