The Division determined <br />the application to be complete for purposes of filing on January 22, 2015. Public notice to that effect has <br />been posted at our Denver office. <br />This revision has been submitted in response to comments made by the Division in an April 21, 2014 <br />review of Annual Hydrology Reports (AHRs) for the King Coal Mine. The Division noted that the <br />permit does not specify whether the standard water year (October 1 to September 30) will be used in <br />monitoring and reporting data, or whether an alternate year will be used. With MR -40, GCC Energy, <br />LLC proposes to use the standard water year, and commits to submitting the AHR by December 31St of <br />each year. The Division accepts this clarification and commitment, but we do have two adequacy <br />comments. <br />Text on permit pages 2.04.7 Page 1 (King I) and 2.05.6 Page 4 (King II) was revised to describe <br />the water year and submittal date for the AHR. In the case of King II, the approved text's <br />commitment to "interpreting" the data in the AHR has (perhaps unintentionally) been omitted. <br />Please restore the wording regarding interpretation of the hydrologic data in the AHR. <br />2. The approved Page 4 of King II 2.05.6 begins with a list of parameters that will be analyzed for <br />surface water discharges. The first parameter is a) Flow (gpm). The Page 4 version submitted <br />with the application is missing the parameters from a) to e), and does not flow with Page 3 of the <br />permit. Please restore the first five parameters to the list on Page 4. <br />On both revised pages, parameter g) Settleable solids is misspelled, and the units shown are <br />incorrect. Rather than mg /L, please revise to read ml /L. <br />This concludes the adequacy review for MR-40. Please submit your response to these items at your <br />earliest convenience.
