The Proposed Decision documents the applicant's compliance with the <br />approved Colorado regulatory program at Rule 3.03.2. <br />This 277.8 acre Phase II bond release applies to the Ashford/Flintock/East Flintock (Z) and <br />Kimber sections (1, 6, 26, 28, 31, 35 and 36.) of the Trapper Mine, Craig, CO. These sections <br />have been retopsoiled, reseeded, and hydrologically balanced. <br />OSMRE participated in the bond release inspection held on October 15, 2014. The Bureau of <br />Land Management (BLM) did not participate in the inspection. By letter, dated December 30th, <br />2014, the BLM provided its concurrence with the SL -16 bond release (attached). OSMRE <br />interprets the BLM's concurrence to mean that Trapper is in compliance with all BLM coal lease <br />stipulations. <br />OSMRE agrees with DRMS that Trapper has met or exceeded the requirements for Phase II <br />bond release on the 277.8 acres of land as described above. The Division currently holds a <br />performance bond in the amount of $30,173,724.00 for the Trapper Mine. No reduction in the <br />amount of the bond is sought with this bond release. OSMRE agrees with the findings and <br />decision document and hereby provides OSMRE concurrence for the above bond release action <br />in accordance with 30 CFR 740.15 (d) (3), and 30 CFR 906.30, Article IX, Section 24, of the <br />State - Federal Cooperative Agreement. <br />Thank you and your staff for coordinating this Federal mine bond release action through the <br />DFD.
