Unless a <br /> stormwater discharge permit is not required (as discussed above), the application should have been <br /> completed and submitted prior to beginning operations or Ocotoberl, 1992, whichever was later. Since <br /> activities have already begun, the application should be returned to Colorado Department of Public Health <br /> and Environment, WQCD-P-B2, 4300 Cherry Creek Drive South, Denver, CO 80246-1530, Attn: Maura <br /> McGovern by (2 weeks). The application requires the preparation of a Stormwater Management Plan <br /> (SWMP). A guidance document on the SWMP preparation has been enclosed. <br /> If High Mountain Mining, LLC fails to obtain a required stormwater permit and discharges stormwater from <br /> the site once industrial activity has started, it is in violation of the Clean Water Act and subject to <br /> enforcement action by the division.
