Heintz Page 5 of 8 <br /> MMM South Platte Combined Replacement Plan <br /> January 8, 2015 <br /> MMM has posted a bond to cover the cost of backfilling or lining in accordance with approach # 1 and <br /> # 3 of the DRMS letter. As this site will include unlined ponds that will permanently exposed ground <br /> water, an application to the water court for a plan of augmentation to cover the long term <br /> depletions from the site must be filed at least three years prior to the completion of mining. A <br /> summary of the final reclamation plans and the approach to replace long term injurious stream <br /> depletions are shown in Table E. <br /> TABLE E - FINAL RECLAMATION SUMMARY <br /> Proposed Final Bond <br /> Site Name _ Reclamation _ Amount Comments <br /> Howe Pit Line Reservoirs n/a Denver Water is permittee and bonds <br /> are not required of municipal entities. <br /> Riverbend East Lined Reservoirs n/a Denver Water is permittee and bonds <br /> are not required of municipal entities. <br /> Bond includes amounts to cover lining <br /> Lined Reservoirs and backfilling of the old Fort Lupton <br /> Riverbend West and unlined ponds $3,450,600 Pit. Will need augmentation plan filed <br /> in court at least three years prior to <br /> the completion of mining. <br /> Conditions of Approval <br /> I hereby approve this substitute water supply plan, in accordance with Section 37-90-137(11), <br /> C.R.S., subject to the following conditions: <br /> 1. This SWSP shall be valid for the period of November 1, 2014 through October 31, 2015, unless <br /> otherwise revoked, modified, or superceded by decree. If this plan will not be made absolute <br /> by a water court action by the plan's expiration date, a renewal request must be submitted <br /> to this office with the statutory fee (currently $257 per site) by September 15, 2015. <br /> 2. The total area of pond surface exposed at the Riverbend West and Riverbend East after <br /> December 31, 1980 for each of the unlined pits shall not exceed those values listed in Table A <br /> of this approval. Should the total surface area exposed exceed those amounts, an <br /> amendment will need to be filed with this office. The total lagged depletions resulting from <br /> operation of the pits shall not exceed those amounts specified in attached Table 5. Should <br /> the lagged depletion from any of the pits exceed the values listed in Table 5, an amendment <br /> will need to be filed with this office. <br /> 3. Well permit no. 55577-F was originally issued for DRMS File No. M-1985-088 for approximately <br /> 70 acres. DRMS File No. M-2000-006 subsequently encompassed M-1985-088 and now covers <br /> approximately 1,250 acres. Prior to any groundwater exposure outside of the original 70 <br /> acres well permit no. 55577-F covers, and new well permit will need to be applied for and a <br /> new 600-ft spacing evaluation must be done. The applicant does not anticipate any ground <br /> water exposure beyond the old M-1985-088 permit boundary and thus a new permit is not <br /> required to be obtained for this SWSP to be valid. <br />
