The Applicant provided a receipt indicating the Gilpin County Development Department <br /> received a copy of the Designated Mining Limited Impact (110d) Reclamation Permit. Rule <br /> 6.3.9 requires that a copy of the application be placed with the local County Clerk and <br /> Recorder for public review. Please provide an affidavit or receipt indicating the date on <br /> which the application was placed with the County Clerk and Recorder for public review or <br /> otherwise demonstrate that a copy of the application is available for review with the Gilpin <br /> County Development Department. <br /> 6.3.10 Exhibit J—Proof of Mailing of Notices to Board of County Commissioners and Soil <br /> Conservation District <br /> 8. As required by Rule 6.3.10,please submit proof that notice of the permit was sent to the <br /> Board of County Commissioners and, if the mining operation is within the boundaries of a <br /> Soil Conservation District, to the Board of Supervisors of the local Soil Conservation <br /> District. Proof of notice shall be in the form of a return receipt of a Certified mailing or a <br /> date-stamped copy of the notice acknowledging receipt by the appropriate local Board. <br /> 6.3.12 Exhibit L—Permanent Man-Made Structures <br /> 9. The Applicant has stated there are no structures within two hundred feet of the affected area. <br /> Please note that permanent man-made structures include roads, fences, and above-ground and <br /> below-ground utilities. Please confirm there are no permanent man-made structures within <br /> two hundred feet of the affected area. If there are permanent man-made structures within two <br /> hundred feet of the affected area then the Applicant shall either: <br /> a. Provide a notarized agreement between the applicant and the person(s)having an <br /> interest in the structure, that the applicant is to provide compensation for any damage <br /> to the structure; or <br /> b. Where such an agreement cannot be reached,the applicant shall provide an <br /> appropriate engineering evaluation that demonstrates that such structure shall not be <br /> damaged by activities occurring at the mining operation; or <br /> c. Where such structure is a utility, the applicant may supply a notarized letter, on utility <br /> letterhead, from the owner(s) of the utility, that the mining and reclamation activities, <br /> as proposed,will have "no negative effect"on their utility. <br /> Your application will not be considered filed until the information listed above is received and <br /> found sufficient to begin our review. A decision date will be established 30 days from the date <br /> of receipt of all of the requested information. Additionally, if you have already published notice <br /> you will need to republish notice, after the Division considers the application submitted. <br /> Republication must occur once within ten(10) days of the submittal date. We will notify you <br /> when you should initiate republication of your notice. The final date for receiving comments is <br /> ten (10) days after the date of publication or the next regular business day. <br />
