Division of Reclamation, Mining and Safety (Division) has completed its third adequacy
review of Braun Environmental's response to the Division's October 20, 2014 Second Adequacy
Review. The Division received a request to extend the decision date to January 15, 2015. The
decision date for this application is currently January 15, 2015. Please be advised that if you are
unable to satisfactorily address any concerns identified in this review before the decision date, it
will be your responsibility to request an extension of the review period. If there are outstanding
issues that have not been adequately addressed prior decision date, and no extension has been
requested, the Division will deny this application.
DETERMINATION OF DESIGNATED MINING OPERATION(DMO)STATUS
The Applicant has disputed the Division's DMO determination and met with the Division on
December 15,2014. The Division will send a final determination letter under separate cover.
With the exception of the original Comment No. 3,related to the toxic materials/acid mine drainage
and ultimately the DMO status, the Division is satisfied all other comments have had adequate
responses submitted.
Please be advised the Mineral Mountain Project Application may be deemed inadequate and the
application may be denied on January 15, 2015 unless the abovementioned adequacy review items
are addressed to the satisfaction of the Division. If you feel more time is needed to complete your
reply, the Division can grant an extension to the decision date. This will be done upon receipt of a
written waiver of your right to a decision by January 15, 2015 and request for additional time.
This must be received no later than the deadline date.
-.of cot,
/44-WP
a 1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us *s *
John W.
