Box 1488 <br />Paonia, CO 81428 <br />Re: Bowie No. 1 Mine (Permit No. C- 1981 -038) <br />TR -59 - Incidental Boundary Revision — Loadout <br />Preliminary Adequacy Review <br />Dear Mr. Bear: <br />An application for TR -59 was received by the Division on December 16, 2014. The package <br />was submitted by J.E. Stover & Associates, Inc. on behalf of Bowie Resources, LLC (BRL) in <br />response to comments made in the Division's report documenting the October 15, 2014 complete <br />inspection of the mine. <br />The application was determined to be complete for purposes of filing on December 27, 2014. <br />Pursuant to 2.08.4(6)(b), public notice of BRL's application was published in the December 31, <br />2014 edition of the Delta County Independent, as verified by the Proof of Publication received <br />on January 9, 2015. The period for public comment came to a close on January 12, 2015. No <br />comments or objections were received. <br />Notification of the application was made by the Division to appropriate agencies and entities, as <br />required by 2.07.3(3). To date, one comment letter has been received. The State Historic <br />Preservation Officer (letter enclosed) opined that "a finding of no historic properties affected is <br />appropriate for this undertaking." <br />Adequacy Review <br />BRL modeled SEDCADA 4 for eight culverts (Culvert 20 through 27) utilizing <br />contributing drainage areas having sedimentologic characteristics representative of on the <br />ground conditions to determine the adequate minimum size of each culvert. The Division <br />believes the parameters utilized were valid to ensure the proper sizing of each culvert. <br />Based on BRL's SEDCAD 4 modeling, the Division finds that the culvert sizing and <br />locations are adequate to control run -off from the associated drainage areas derived from <br />Map 7.
