A population of Southern Red Belly Dace exists in <br />Hardscrabble /Low Back Creek drainage. Southern Red Belly Dace are listed as endangered in <br />Colorado. CPW lists Newlin Creek as deer and elk winter range. The habitat the Newlin <br />Creek drainage provides and the aquatic and terrestrial wildlife that utilize it are an <br />important resource to the People of Colorado and the residents of Fremont County. <br />CPW has reviewed the water quality data collected through the monitoring efforts of Energy <br />Fuels Coal Inc. and recognizes that to date no water quality issues have been detected. <br />Providing that reclamation has been completed to the satisfaction of the Division of <br />Reclamation, Mining and Safety, and water leakage from the mine area is not a concern, CPW <br />would endorse the termination of the water monitoring program. <br />Sincerely, <br />James L.
