The Site Specific Development Plan and Special Review Permit is for an <br /> open cut sand and gravel operation to include stockpiling, recycling <br /> and processing of demolition materials (asphalt and concrete) as <br /> submitted in the amended application materials on file in the <br /> Department of Planning Services and subject to the Development <br /> Standards stated herein. <br /> 2. Approval of this plan may create a vested property right pursuant to <br /> Section 90 of the Weld County Zoning Ordinance. <br /> 3. Petroleum products and compressed flammable gases are hazardous <br /> substances per C.A.S. 29-22-107 (2) (a). Prior to the issuance of <br /> building permits, the applicant shall provide a list of the maximum <br /> quantities of hazardous substances expected at the site and emergency <br /> phone numbers to the State Health Department. Division of Waste <br /> Management, the Weld County Emergency Response Coordinator, and the <br /> Western Hills Fire Protection District. Evidence of this listing and <br /> emergency phone numbers shall be provided to the Department of Planning <br /> Services prior to the issuance of building permits. <br /> 4. Vehicular traffic shall ingress and egress onto Weld County Road 41.5 <br /> as shown herein on the submitted Special Review plat. The haul route <br /> shall be from the point of ingress and egress south to Colorado Highway <br /> 263. <br /> 5. The property owner(s) and/or operator shall apply for a well permit <br /> with the Division of Water Resources to comply with C.R.S. 37-90-137. <br /> Prior to extraction of sand and gravel, a copy of the approved well <br /> permit application shall be forwarded to the Department of Planning <br /> Services. <br /> 6. The Special Review area shall be enclosed by a six foot chain-link <br /> fence with a three-strand barbed wire top. The fence shall be erected <br /> prior to beginning the sand and gravel operation. <br /> 7. Signs stating "No Trespassing' shall be posted and maintained on the <br /> chain link fence at intervals of two-hundred feet (200'). <br /> 8. The owner/operator shall maintain a fifty-foot (50') setback from <br /> Balsam Avenue in the mining operation. <br /> 9. Structures on the site shall not exceed one-hundred-fifty feet (150') <br /> in height, in accordance with Airport Zona Height Limitations, Section <br /> 51.3 of the Weld County Zoning Ordinance. <br /> 920610 <br />
