6) The Division understands that portions of the access road are existing ranch roads. <br /> Please describe what improvements will be made to the existing road if any. <br /> Portions of the existing ranch road that coincide with the access road will be <br /> improved(graded,surfaced,etc.)as needed. <br /> 7) Part 2 and Reclamation Performance Required standards Follow: The <br /> Operator/Applicant stated that the entire affected area will be reclaimed to rangeland. <br /> The access road is part of the affected land. Will the access road be reclaimed after <br /> mining? If the road will remain after mining please provide a notarized letter from the <br /> landowner demonstrating that the landowner will take ownership of the access road after <br /> the site is released. <br /> The Land Owner required that the access road remain within the Lease Agreement <br /> (see Exhibit"N"). Below is the requirement: <br /> 5. Access Easement.As further consideration for LESSEE'S agreement to enter into this <br /> Lease,LESSOR hereby agrees that it shall and hereby does grant to LESSEE a fifty foot(50')wide <br /> accescingress and egress easement over and across LESSOR'STeal property described In <br /> Exhibit"B" attached hereto and incorporated herein by this reference(the"Easement"),to and <br /> from the Premises,which Easement shall be for LESSEE'S use In connection with its production, <br /> transportation,and general operations on the Premises. Said easement shall be temporary and <br /> shall terminate without further action of either party upon termination of this tease. Upon <br /> termination of this Lease,LESSEE shall leave the access as improved from time to time by the <br /> Lessee in place and any improvement on the access easement shall become the property of the <br /> LESSOR. <br /> 8) Please illustrate on the Reclamation Plan Map how the road will be reclaimed. <br /> REVISED AND EMAILED ON 01/09/15 <br /> 9) Please have the map signed by a registered land surveyor,professional engineer,or other <br /> qualified person as required by Rule 6.2.1(2)(b). <br /> SIGNED AND EMAILED ON 01/09/15 <br /> 10) In Review of Exhibit B the index Map, It appears that the access road which is within the <br /> permit boundary,crosses parcel# 17662 which is owned by Corsentino,Andrew H and <br /> Mary Alice. The Operator/Applicant will need to provide Legal Right to enter parcel <br /> #17662. If this is not correct please clarify. <br /> The access road is contained within City of Walsenburg property. REVISED AND <br /> EMAILED ON 01/09/15 <br /> 11) Will the mining operation adversely affect the stability of Highway 10 and the overhead <br /> power lines that parallel Highway 10? If so the Applicant/Operator will need to obtain <br /> structures agreements. <br /> It is our opinion that this mining operation will not adversely affect Highway 10 or <br /> the overhead power lines. The pit entrance at this location is already improved with <br /> a gate and is utilized to access another gravel pit and the Holita Reservoir. <br /> 12) Please provide any of the following for the permanent man-made structure located <br /> within two hundred(200)feet of the affected land identified in permit application: <br /> file(LoneTreeResponse.odt) <br />
