Box 1488 <br />Paonia, Colorado 81428 <br />Re: Bowie No. 1 Mine (Permit No. C- 1981 -038) <br />Surety Release No. 5 (SL -05) — Partial Phase I and Phase II <br />Preliminary Adequacy Review <br />Dear Mr. Bear: <br />In accordance with Rule 3.032(1), an application for partial surety release (SL -05) at the Bowie <br />No. 1 Mine has been submitted on behalf of Bowie Resources, LLC (BRL) by J.E. Stover & <br />Associates, Inc. Phase I release [3.03.1(2)(a)], for backfilling, regrading, and drainage control, is <br />requested for 0.45 acres at the West Mine Fan Bench. Phase II release [(3.03.1(2)(b)], for <br />establishment of vegetation type and cover, is being sought for 13.8 acres at the West Mine and <br />for 10.2 acres at the Timber Storage (Run -of -Mine) Area, for a total of 24.0 acres. BRL requests <br />a surety liability release of $250,000. <br />Completeness - 2.07.3(1) <br />The initial application was received by the Division on September 23, 2014, and was determined <br />to be incomplete on October 22, 2014. BRL satisfied the issues raised by the Division, and the <br />application was deemed complete for purposes of filing on October 23, 2014. Notice of <br />completeness was provided to the Bureau of Land Management (BLM), the Office of Surface <br />Mining (OSM) and the Western Slope Conservation Center. <br />Public Notice 2.07.3(2) <br />An initial public notice appeared in the Delta County Independent four times between September <br />17 and October 8, 2014. During the Completeness review, the Division identified certain <br />information that was missing from the notice. BRL re- published beginning on October 29. The <br />final publication occurred on November 19, resulting in December 19, 2014 being the final date <br />for public comment. No comments or objections were received from the general public, or from <br />the individual landowners who were notified by U.S. mail of the application.
