COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />January 8, 2015 <br />To: Marcia Talvitie <br />From: Jason Musick <br />RE: King Coal Mine, C- 1981 -053 <br />2015 Midterm Review <br />Rule 2.04.7(2) - Information in compliance with Rule(s) 2.04.7(2)(a), (b)(i -ii) was located in: Sections KI <br />2.04.7, K I 1 2.04.7, K I Appendix 4, K 11 Appendix 4, and on Maps Map I - 007 and Map 11 - 007. <br />The Division has no adequacy comments or concerns with regard to Rule 2.04.7(2). <br />Rule 2.04.7(4) - Information required by Rule 2.04.7(4) was identified on Maps: Map 1 -004, Map 1 -007, <br />Map 11 -7, Map 11 -7A, and Map 11 -76. All information required under 2.04.7(4) was in compliance with the <br />exception of the following: <br />Rule(s) 2.04.7(4)(a -g) states that a map prepared according to the standards of Rule 2.10 <br />showing the locations of: water supply intakes, ditches, reservoirs, and wells within a one mile <br />radius of the affected area is required (by definition, the affected area is any water or land <br />which the mining activity is conducted and land or water which is located above underground <br />workings); elevations and locations of monitoring stations used to gather water quality and <br />quantity data; surface water bodies within the permit area; the location of gas and oil wells <br />within the proposed permit boundary and water wells in the permit and adjacent area; and the <br />elevation and location of test borings and core sampling. Please revises any Maps with updates <br />to features required under 2.04.7(4) that may have been installed or removed since the last <br />update. <br />Rule 2.04.7(5) - No new information regarding seasonal variability of surface and groundwater quality <br />and quantity has been required or submitted. The Division's determination to accept and approve the <br />operator's application with the previously approved water quality and quantity information remains in <br />place. <br />Rules 2.04.11 - Information required by Rule 2.04.11 is identified in section(s) K 1- 2.04.11 and K 11- <br />2.04.11; and K I Appendix 8 and K II Appendix 8. The fish and wildlife study required under 2.04.11 <br />consisted of a review of the wildlife species lists on the Natural Diversity Information Source of the DPW <br />and the Colorado Natural Areas Program database for the areas of the King I and II Mines. A survey was <br />conducted for development drilling locations in 2014.
