Brannan agrees to exercise the rights herein granted to it with due care; to <br />minimize the actual area of the Permanent Easement and Temporary Construction Easement <br />disrupted during any period of construction; and, after such construction, to restore the surface <br />contours of the Permanent Easement and Temporary Construction Easement to those existing <br />before such construction (but after filling the Property as described above) and revegetate the <br />surface of the Permanent Easement and Temporary Construction Easement to minimize erosion. <br />2. Grantor reserves the right and privilege to use the Permanent Easement and <br />Temporary Construction Easement for all purposes other than: (a) those purposes or uses that <br />are granted to Brannan herein, (b) those purposes or uses that might interfere with, be <br />inconsistent with, or be detrimental to the purposes and uses granted to Brannan herein. Grantor <br />specifically agrees that, within the Permanent- Easement and within the Temporary Construction <br />Easement (during the term of the Temporary Construction Easement), Grantor shall not: (a) erect <br />or construct any building, structure, or other obstructions, (b) drill or operate any well, or (c) <br />diminish or substantially add to the ground cover. <br />3. Grantor, for itself, and its successors and assigns does hereby covenant and agree <br />that this Grant of Easement shall attach to and run with the Property and shall be binding not <br />only upon Grantor, but also upon Grantor's successors and assigns and any other persons or <br />entities which hereafter acquire an ownership or leasehold interest in all or a portion of the <br />Property in the future. <br />[Signature pages follow] <br />2 <br />
