S. All personal property taxes, insurance, utilities and other costs associated with the <br />Extraction Activities shall be paid by Grantor. <br />' 6. Grantor shall keep the Property, and every part thereof, free and clear of any and all liens <br />for labor done, work performed or materials provided for the Extraction Activities, and <br />' shall indemnify the fee owner of the Property against the assertion of any such claims or <br />liens. Grantor shall have the right to contest the assertion of any such claim or lien <br />provided that in the event of foreclosure or threatened foreclosure in connection with the <br />' assertion of any such lien, Grantor shall, at its cost, provide such bond, escrow or other <br />security as may be necessary to preclude the prosecution of any such foreclosure. <br />I 7. Grantor shall have the right to assign and/or convey its reserved mineral extraction rights <br />or any part thereof without the prior written consent of the fee owner of the Property. <br />' <br />S. Grantor shall, at its sole cost and expense, be responsible for developing and adjudicating <br />any plan or plans for augmentation, to the extent required by Colorado law for the <br />replacement of evaporative losses of the moisture content of the material being mined <br />' from the Property. Grantor shall also be responsible for obtaining any water rights as may <br />be necessary for such augmentation plan(s) at its sole cost and expense. The obligation of <br />Grantor to comply with such plan(s) of augmentation and maintain same shall terminate <br />' upon the termination or expiration of Grantor's reserved mineral extraction rights. <br />9. Grantor will be responsible for meeting all of the terns of its reclamation plan. No <br />' modifications to the reclamation plan will be made without the consent of the fee owner <br />of the Property if the same adversely affect any interest in the Water Storage Easement <br />(reserved by Grantor pursuant to the underlying Warranty Deed) that has been conveyed <br />tto the fee owner of the Property. <br />i10. The fee owner of the Property shall have: <br />a. The right to enter upon the Property for inspection purposes, upon advanced <br />' written notice, during normal business hours, provided that in exercising such <br />right the fee owner of the Property shall not unduly interfere with Grantor's <br />Extraction Activities; and <br />' b. The right to enter upon the surface of the Property to the extent that such entry <br />does not unreasonably interfere with Grantor's Extraction Activities. <br />' 11. The fee owner of the Property shall be responsible for payment of all real property taxes <br />assessed against the Property and any other similar costs of ownership of the Property, <br />' except for taxes or assessments relating to the mining activity of Grantor or relating to <br />any property reserved by Grantor. <br />L%dia nbMM* a cmked-U B cfVath 10 <br />
