F cI D N R V
7 January 2015
COLORADO
Division of Reclamation,
Mining and Safety
Department of Natural Resources
Tom Bird, Manager of Coal Services
GCC Energy, LLC
6473 County Road 120
Hesperus, CO 81326
Re: King Coal Mine (Permit No. C- 1981 -038)
Review of Coal Mine Waste Bank Inspection Report
3rd Quarter 2014
Dear Mr. Bird:
The King Coal Mine operates a permitted Coal Mine Waste Bank (Refuse Pile), located at the
King I Mine surface facilities. A certified inspection report covering the 3rd Quarter of 2014 was
submitted by GCC Energy, LLC (GCC) on 6 October 2014. Attached to this letter, please find a
table documenting the Division's review of the subject inspection report.
In the Division's 18 July 2014 review of reports which spanned the 3rd Quarter of 2012 through
the 2nd Quarter of 2014, we found that certain elements of the inspection requirements for Coal
Mine Waste Banks were not being adequately addressed. In that letter, we requested that GCC
ensure that the Refuse Pile is inspected pursuant to the requirements of Rules 4.09.1(11) and
4.10.2 for future reports. Significant progress has been made in this regard, although a few
points remain to be addressed; please refer to the attached table for details.
In our 18 July 2014 letter, we also requested that the refuse pile inspection report be submitted
separately from the inspection of sediment control features. We appreciate GCC's adopting this
protocol with the 3rd Quarter 2014 reports.
Please contact me with any questions you may have regarding this topic.
Best regards,
Marcia L.
