PERMIT#:M-1991-082 <br /> INSPECTOR'S INITIALS:TC1 <br /> INSPECTION DATE:December 23,2014 <br /> OBSERVATIONS <br /> This inspection was initiated by a Succession of Operator (SO) request. The Operator was represented by Mr. Jay Baker <br /> who was present for the initial part of the inspection, but left about 30 minutes before this specialist completed the <br /> inspection. The Tiger Timber Site is located approximately 800 feet due north of the intersection of U.S. Hwy 24 and <br /> Teller County Rd 1 in Florissant, CO. <br /> Inspection: <br /> A permit sign was displayed (see Photo 1) at the site entrance. Between 1 and 3 inches of snow covered most of the <br /> site. The site was not active at the time of the inspection and Mr. Baker stated not much material had been mined since <br /> the previous inspection. Several rolling dumpsters and roll off bins(see Photo 2)were stored on the pit floor. Mr. Baker <br /> indicated these were for his solid waste business and that his primary reason for acquiring the site was for storage of <br /> this equipment. Although storage of this equipment is not specifically allowed by the approved permit, the dumpsters <br /> and bins all have wheels and are considered portable. <br /> Mr. Baker indicated the woodchips and sawdust left over from the sawmill intended to be blended with the topsoil (as <br /> stated in the approved reclamation plan) have been blended with the topsoil stockpiles on the southern edge of the site. <br /> Mr. Baker asked if there was a way the Division could keep the current bond as it is associated with the site. This <br /> specialist replied that the bond needs to be assigned to the Operator, not the site. <br /> File Review Notes: <br /> • The total permitted area is 5.6 acres. <br /> • The approved reclamation plan shows the northeast part of the pit being sloped at 2.6H:1V and the north pit <br /> wall sloped at 2.3 to 2.5H:1V(see attached reclamation plan). <br /> • The previous inspection was performed on 5/8/2012. No problems were noted. <br /> • There is a$10,000 financial warranty(CD)for the site,which has not been updated since 1991. <br /> • Annual fees and reports are up to date through 2014. <br /> • The post-mine land use is commercial/industrial for the sawmill operation. Side slopes are to be vegetated, but <br /> not the pit floor. <br /> • Portable dumpsters — as this equipment is considered portable, the Division will not require a change to the <br /> financial warranty, mining, or reclamation plans for their removal. <br /> • When compared to photos from the 11/17/2005 inspection, some significant backfill has occurred in the <br /> northeast portion of the pit(see Photos 3 and 4) <br /> Bond: <br /> The current financial warranty is a $10,000.00 corporate surety held by the estate of Frank Laughrey. The Division <br /> updated the unit costs and provided credit for the backfilling work done on the northeast portion of the pit. The revised <br /> bond estimate is included in this report as Attachment A. Slope estimates based on site observations are presented in <br /> Attachment B. The revised bond required by the Division is$14,440.00. <br /> Current Stipulations: <br /> None. <br /> Summary: <br /> The site appears to be in compliance with the approved permit. The Division will require the updated bond be <br /> submitted prior to approval of the requested SO revision. The request for the new bond will come under separate <br /> cover. If the new bond is not received by the Division within the time frame required by the forthcoming letter, the <br /> Division will deny the SO and the estate of Frank Laughrey will be responsible for the revised bond. <br /> Page 2 of 5 <br />
