Harms Pit CN -01 Adequacy Letter <br />Page 2 of 3 <br />December 24, 2014 <br />6.4 SPECIFIC EXHIBIT REQUIREMENTS — REGULAR 112 OPERATIONS <br />The following items must be addressed by the Applicant in order to satisfy the requirements of <br />C.R.S. 34- 32.5 -101 et seq. and the Mineral Rules and Regulations of the Mined Land Reclamation <br />Board: <br />6.4.3 Exhibit C - Pre - Mining and Mining Plan Maps of Affected Land <br />4. Please update Maps C -1 and C -2 to indicate the pipeline and wind turbine owners. <br />5. Please confirm no utilities or utility easements are present along Weld County Road 127. <br />6. The Applicant states wind turbine N -9 of the Cedar Creek II Wind Farm is located approximately <br />300 feet northeast of the affected area. The wind turbine appears to be located approximately <br />180 feet from the northeast permit boundary corner based on scaled distance on Map C -2. Please <br />confirm the distance from the permit boundary to wind turbine N -9. <br />6.4.7 Exhibit G - Water Information <br />7. The Applicant states the source of water for dust control will be trucked to the site from a <br />permitted well owned by the landowner. Please provide documentation the landowners well is <br />permitted for industrial use. <br />6.4.12 Exhibit L - Reclamation Costs <br />8. The Division has reviewed and accepts the Applicant's reclamation cost estimate. The financial <br />warranty amount will be set at $61,267.33 following approval of the conversion application. <br />6.4.14 Exhibit N — Source of Legal Right to Enter <br />9. The lease agreement submitted by the Applicant as the source of legal right to enter is between <br />Janyce Harms and Pine Bluffs Gravel and Excavating, Inc. According to the Weld County records <br />the section of land is owned by Harms Ranch, LLC, not Janyce Harms, and the registered agent is <br />Kenneth R. Roney. Please provide a lease agreement between Pine Bluffs and Harms Ranch, LLC <br />or provide a different source of the Applicants legal right to enter per Rule 6.3.7. <br />6.4.15 Exhibit O — Owners of Record of Affected Land and Owners of Substance to be Mined <br />10. The Applicant states Janyce Harms is the owner of Section 34, T11N, R58W and the sand and <br />gravel to be mined. According to the Weld County records the section of land is owned by <br />Harms Ranch, LLC. Please revise the exhibit and the permit application accordingly. <br />6.4.18 Exhibit R - Proof of Filing with County Clerk and Recorder <br />11. Please provided an affidavit or receipt indicating the date on which the revised application <br />information required to address this adequacy letter was placed with the Weld County Clerk <br />and Recorder for public review, pursuant to Subparagraph 1.6.2(1)(c). <br />
