Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />December 23, 2014 <br />Tena Gallagher and Linda Saunders - K2T LLC <br />34315 Forest Park Dr. <br />Elizabeth, CO 80107 -7842 <br />RE: Southfield Mine, Permit No. CA 981 -014 <br />E- mail/Letter Objection to Technical Revision No. 43 (TR -43) <br />Dear Ms. Gallagher and Ms. Saunders: <br />We received your letter via e-mail on December 8, 2014 which specifically states your <br />objection to TR -43 (dated December 7, 2014). On the same day we received a second <br />letter via e -mail from Mr. Ted Coulter of South Central Land & Mining LLC (dated <br />December 5, 2014). Both letters are similar and convey essentially the same information. <br />In addition to TR -43 these two letters also address TR -40 and Notice of Violation CV- <br />2013 -002 in regards to MW -NW. We are in the process of reviewing this latest <br />correspondence and are continuing to assess all data related to potential hydrology related <br />impacts at the Southfield Mine. A synopsis of the status of each of the aforementioned <br />revisions and the pending violation are provided below. <br />Technical Revision No. 43 <br />The application for TR -43 was received by the Division of Reclamation, Mining and <br />Safety on November 6, 2014. The revision requested that EFCI be approved to terminate <br />all water monitoring at the Southfield Mine. TR -43 was found to be complete on <br />November 14, 2014. The Division received comments from Dr. Corley (landowner) on <br />Novemberl9, 2014 regarding EFCI's request to terminate water monitoring. The <br />Division has commenced its review of TR -43 and is currently preparing an adequacy <br />review letter. The decision due date for TR -43 is January 13, 2015 however, given the <br />complexity of this revision, the Division will likely extend the decision due date to <br />provide sufficient time to conduct a thorough review. <br />Technical Revision No. 40: Withdrawn by EFCI <br />TR -40 was received by the Division on December 31, 2012. The revision was submitted <br />to remove monitoring well MW-NW from the approved water monitoring program. On <br />January 10, 2013 the Division found the application to be incomplete due to the lack of <br />information and supportive evidence to remove MW -NW from the water monitoring <br />program.
