<br />I, the undersigned agent, do solemnly swear that the
<br />CANON CITY DAILY RECORD is a daily newspaper
<br />published in the City of Canon City, County of Fremont,
<br />State of Colorado, and which has general circulation therein
<br />and in parts of Fremont, Park and Chaffee Counties; that
<br />said newspaper has been continuously and uninterruptedly
<br />published for a period of more than six months next prior to
<br />the first publication of the annexed legal notice of
<br />advertisement, that said newspaper has been admitted to the
<br />United States mails as second -class matter under the
<br />provisions of the Act of March 3, 1879, or any amendments
<br />thereof, and that said newspaper is a daily newspaper duly
<br />qualified for publishing legal notices and advertisements
<br />within the meaning of the laws of the State of Colorado; that
<br />a copy of each number of said newspaper, in which said
<br />notice of advertisement was published, was transmitted by
<br />mail or carrier to each of the subscribers of said newspaper,
<br />according to the accustomed mode of business in this office.

<br />Technical Revision No.44 (TR -44) - Southfield
<br />Mine - Permit No. C -81 -014
<br />Revision Request to Change Status of Pond 5
<br />to a Permanent Structure.
<br />Energy Fuels Coal Inc. (EFCI), 115 E. Main
<br />Street, STE 10, P.O. Box 459, Florence, Colo-
<br />rado 81226, has filed an approval request for
<br />Technical Revision No.44 (TR -44) with the
<br />State of Colorado, Division of Reclamation,
<br />Mining and Safety (DRMS). All mining opera-
<br />tions subject to this permit have ceased, and only
<br />reclamation and monitoring activities are occurring.
<br />Items addressed by the TR -44 Revision Re-
<br />quest consist of conversion of the temporary
<br />status of sedimentation Pond 5 to a perma-
<br />nent status whereby the pond remains as a
<br />permanent structure for the purpose of sup-
<br />plying a water source to support wildlife and
<br />livestock watering. Leaving Pond 5 as a per-
<br />manent structure will enhance the approved
<br />post mining and use which is approved for
<br />rangeland livestock grazing and wildlife
<br />habitat.
<br />The Southfield Mine area is located approxi-
<br />mately eight miles south of Florence, Colo-
<br />rado, on County Road 92. The Mine area is
<br />bounded on the south and west by the base
<br />of the Wet Mountains, and Newlin Creek bi-
<br />sects the mine area from southwest to north-
<br />east.
<br />The Southfield Mine permit area is located on
<br />portions of the following sections:
<br />Sections 19, 30, and 31; Township 20S,
<br />Range 69W, 6th Principal Meridian
<br />Sections 23, 24, 25, 26 and 36; Township
<br />20S, Range 70W, 6th Principal Meridian
<br />These sections are shown on the U.S.
<br />Geological Survey 7.5 minute Rockvale quad-
<br />rangle map (Mine Area).
<br />Pond 5 is situate in the SW4, SE4, Section
<br />19, Range 69W, Township 20S of the 6th
<br />P.M.
<br />A complete copy of the Southfield Permit Re-
<br />vision Application is on file and available for
<br />public inspection in both the Clerk and Re-
<br />corders Office in the Fremont County Court-,
<br />house, Canon City, Colorado, and the DRMS'
<br />offices located at the following address:
