Brock Bowles <br />Page 3 of 8 <br />December 12, 2014 <br />Rule 2.05.4(2)(a): A detailed reclamation plan and timetable for completion are presented in <br />Section 2.05.4 of the permit application package. Based on the currently approved mining plan, in <br />addition to contemporaneous reclamation of the pit areas, WFC anticipates final reclamation of <br />facilities and roads commencing in 2019 and sedimentation pond removal in 2029. <br />Rule 2.05.4(2)(b): The estimated reclamation costs for the New Horizon North Mine have been <br />updated by the Division to reflect 2014 unit costs. The revised reclamation cost estimate is <br />$5,254,691.17. The detailed cost estimate is attached for your review and comment. <br />Rule 2.05.4(2)(h): The air pollution control plan is presented in Section 2.05.6(1) of the permit <br />application package. WFC has obtained a construction permit from the Air Pollution Control <br />Division of the Colorado Department of Public Health and Environment for mining and hauling <br />activities at the New Horizon North Mine. The permit sets limits for emissions of air pollutants, <br />duration of equipment activity, disturbed area acreage, material storage volumes, and blasting <br />materials usage. WFC has proposed mitigation measures (chemical stabilizer application on long <br />term disturbance areas such as overburden or topsoil stockpiles and water application on roadways <br />and equipment operation areas) to control fugitive dust and emissions. <br />Rule 2.05.6 Mitigation of Impacts of Mining Operations <br />Pertaining to surface water - <br />Rule 2.05.6(3)(a): Section 2.05.6(3) of the permit application package, "Protection of the <br />Hydrologic Balance ", includes a discussion of the possible impacts of the operation on the <br />hydrologic balance and the measures that WFC will employ to mitigate any adverse effects. <br />Rule 2.05.6(3)(a)(i): Protection of the quality of surface water is discussed on page 4 of Section <br />2.05.6(3) of the permit application package. WFC will construct a total of three proposed <br />sedimentation ponds to ensure that drainage from the disturbed areas does not contribute excess <br />suspended solids and negatively impact the quality of surface water within and adjacent to the <br />mining activities. <br />Backfilling, regrading, and topsoil redistribution activities will be conducted to ensure that runoff <br />will not come into contact with materials that would contribute to elevated levels of acid or toxic <br />constituents and subsequently result in adverse impacts to surface water quality. <br />Rule 2.05.6(3)(a)(ii) and (iii): WFC has received approval for an augmentation plan to mitigate the <br />effects of water retention in the proposed sedimentation ponds on present users of surface water. <br />The approved augmentation plan has been incorporated into the permit application package as <br />Appendix 2.05.6(3) -1c. <br />Rule 2.05.6(3)(a)(iv): NA — rule pertains to underground mining operations. <br />
