Box 580 <br /> Rye,CO 81069 � <br /> Re: Midwestern Farms,Permit No.M- 993-059,Noncompliance with Office of the State <br /> Engineer Requirements for Exposed Groundwater <br /> Mr. Read, <br /> Since the Division of Reclamation, Mining and Safety(Division)conducted the inspection of the <br /> Midwestern Farms site(Permit No.M-1993-059)on April 04, 2014,it has come to our attention that <br /> the current amount of exposed groundwater at this site is not in compliance with the Office of the <br /> State Engineer(SEO). <br /> According to the SEO (see enclosed comments),the Operator needs to reapply with the SEO to re- <br /> permit the gravel pit ponds for the increase in surface area of exposed groundwater from 28.5 acres <br /> (exposed in 1999 when Permit No. 53050-F was issued)to 98.4 acres currently exposed. <br /> Rule 3.1.6(1)(a)requires compliance with Colorado water laws and regulations governing injury to <br /> existing water rights both during and after mining. Therefore,the site will need to regain compliance <br /> with the SEO in order to be in compliance with the Division. <br /> Please provide documentation to the Division that proves you are working with the SEO to meet their <br /> requirements for exposed groundwater.
