PERMIT#:M-1989-120 <br /> INSPECTOR'S INITIALS:PSH <br /> INSPECTION DATE:December 1,2014 <br /> 2012 image indicates an offset of 100 feet and the June 2010 image indicates an offset of 150 feet from the <br /> bank of the Platte River to the eastern edge of the Phase 2 wetland bench. The images are attached for <br /> reference. <br /> The large erosion feature on the east side (cut bank) of the Platte River has developed over the last couple of <br /> years. Mrs. Davis stated the erosion feature would be repaired prior to the spring runoff. The erosion repair <br /> work may be done as part of an upcoming outlet structure construction project. The outlet structure would <br /> regulate the groundwater lake elevation in Phases 2 and 4 by allowing excess water to discharge to the Platte <br /> River. A technical revision to the approved Mining Plan is required prior to completion of this project. The <br /> Division requests notice of the completed erosion feature repair work, including any engineering designs and a <br /> copy of the 404 permit, if required following the conclusion of the repair. This repair work should reestablish <br /> the minimum 100 feet offset from the South Platte River. <br /> In 1990, when the original permit application was approved the Reclamation Plan included a number of <br /> requirements for installation of flood management structures. The requirements included riverside armoring, <br /> the raising of the existing dike and constructing a spillway and lateral berm along the southwest section of <br /> Phase 2. The requirements were summarized in a memo by Allen Sorenson with the Division dated October <br /> 17, 2003. A copy of the memo is attached for reference. <br /> During the first amendment application (AM-01) process in 2003, the Operator committed to backfill the pit to <br /> at least 200 feet from the river by April 2004 in areas where mining has occurred to within 100 feet of the river <br /> as an interim flood control measure. The Operator committed to backfill the pit area closest to the Platte <br /> River to at least 400 feet from the river as the final flood control measure. These interim and final backfilled <br /> areas are required instead of constructing the 1990 approved flood control structures. A copy of the <br /> Adequacy Review Comments letter dated December 1, 2003 is attached for reference. See Item #17. As cited <br /> as a problem on the first page,the Operator failed to backfill the portions of Phase 2 mined within 100 feet <br /> of the South Platte River to at least 200 feet from the river bank by April 2004. Additionally,the Operator <br /> has constructed what appears to be the final wetland bench in the area and the benches are not the <br /> required 400 feet from the South Platte Riverbank. The Division will require the Operator to document they <br /> are incompliance with the approved backfilling requirements along the South Platte River or submit a plan to <br /> achieve compliance in the form of a technical revision to the Reclamation Plan within 60 days of the mailing <br /> date of this inspection report. <br /> Photographs taken during the inspection are attached. An inspection map based on the latest Google Earth <br /> image is attached. The blue polygon represents the Broda backfill area in Phase 4,the green polygon <br /> represents the Phases 2 and 4 wetland bench areas and the erosion feature along the South Platte River cut <br /> bank is marked and labeled. <br /> Page 3 of 6 <br />
