If a <br /> Possible Violation is indicated, you will be notified under separate cover as to when the Mined band <br /> Reclamation Board will consider possible enforcement action <br /> INSPECTION TOPIC: Backfilling & Grading <br /> PROBLEM/POSSIBLE VIOLATION: Problem: The Operator failed to backfill the sections of Phase 2 mined within <br /> 100 feet of the South Platte River to at least 200 feet from the river bank by April 2004. Additionally, the <br /> Operator has constructed what appears to be the final wetland bench in the area and the benches are not the <br /> required 400 feet from the South Platte River bank. <br /> CORRECTIVE ACTIONS:The Operator must document they are incompliance with the approved backfilling <br /> requirements along the South Platte River or submit a plan to achieve compliance in the form of a technical <br /> revision to the Reclamation Plan within 60 days of the mailing date of this inspection report. <br /> CORRECTIVE ACTION DUE DATE: 2/14/15 <br /> INSPECTION TOPIC: Signs & Markers <br /> PROBLEM/POSSIBLE VIOLATION: Problem: The mine identification sign was not posted at the entrance of the <br /> mine site. This is a problem for failure to post a mine identification sign as required by Section 3.1.12(1) of the <br /> Rule. <br /> CORRECTIVE ACTIONS: The Operator shall, at the entrance of the mine site, post a sign which shall be clearly <br /> visible from the access road with the following: the name of the Operator, a statement that a reclamation <br /> permit for the operation has been issued by the Colorado Mined Land Reclamation Board; and the permit <br /> number.
