bond release inspection and other prior site inspections, the Division finds that Trapper Mining, Inc. has <br />replaced topsoil in accordance with the approved reclamation plan. Trapper Mining, Inc. has established <br />vegetation which supports the approved post -mine land use and meets the approved success standard for <br />vegetative cover. The Division finds that the reclaimed area subject to this bond release is not <br />contributing suspended solids to streamflow or runoff outside the permit area in excess of pre - mining <br />levels or in excess of adjacent non -mined areas. <br />IV. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve Trapper Mining, Inc.'s request for a <br />partial Phase H bond release for the 277.8 -acre bond release block "A, F, K &Z RSAB &C 2005- 2010" <br />at the Trapper Mine. This proposed decision will release the applicant from Phase II reclamation <br />liability for the SL -16 bond release parcels. <br />The reclamation cost estimate was last evaluated during the SL -15 bond release process in January 2014 <br />and subsequently increased in September 2014 as a result of MR220. Based on the most recent cost <br />estimate, the required liability for the site is $27,407,072.54. The Division currently holds a <br />performance bond of $30,173,724.00. The Division proposes to release reclamation liability in the <br />amount of $376,228.82 for the 277.8 -acre SL -16 bond release block. This amount is not greater than <br />85% of the applicable bond for these bond release parcels in accordance with Rule 3.03.1(2)(b). Trapper <br />Mining, Inc. did not request a reduction in bond amount with the SL -16 bond release application. <br />However, should Trapper Mining, Inc. reduce its liability by $376,228.82, the remaining liability amount <br />of $27,030,843.72 should be sufficient to complete the remaining reclamation work at the site if the <br />work had to be performed by the Division, including the cost of reestablishing vegetation on any <br />revegetated areas, should those areas fail. <br />Any person with a valid legal interest which might be adversely affected by this proposed decision may <br />request a formal public hearing before the Mined Land Reclamation Board in accordance with Rule <br />3.03.2(6). Public notice of this proposed decision will be published twice in the Craig Daily Press as <br />soon as possible. Requests for public hearing must be submitted to the Division in writing within thirty <br />days of the first publication in the Craig Daily Press.
