• Topsoil replacement at the Timber Storage (a.k.a. Run -of -Mine) Area was verified at 10
sites, with approximate locations shown on Photo 8 (taken 14- May - 2014). No spoil was
encountered in the holes. In general, the soil was rockier than what was encountered at the
West Mine. This may be due to the Timber Storage Area's having been disturbed prior to the
passage of SMCRA legislation, when salvaging of topsoil was not required.

PROCESSING WASTE /COAL MINE WASTE PILES — Rule 4.10 and 4.11
Drainage Control; Surface Stabilization; Placement:
• There are two coal mine waste disposal areas for the Bowie No. 1 Mine. Both structures are
located at the East Mine, and were the subject of an OSM Special Focus Oversight Inspection
in May 2014. The requirement for quarterly inspections of the West Ridge Waste Bank was
terminated in January 2010 under TR -52.
• The West Ridge Waste Pile and the "Old" Refuse Pile were inspected and found to be in
good condition, with no evidence of instability or erosion.
SLIDES and DAMAGE - Rule 4.12:
• We observed no evidence of any slides having occurred within the disturbed areas.
BACKFILL and GRADING — Rule 4.14
Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall
Elimination 4.14.1(2)(f); Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials
4.14.3; Stabilization of Rills and Gullies 4.14.6:
• Surface ownership of the West Mine Fan Bench is divided between BRL (Section 14) and
the Bureau of Land Management (Section 23). During the inspection, Mr. Stover noted that
the reclaimed area appeared to be larger than 0.45 acres in size. Division measurements
taken subsequent to the inspection indicate the area may be closer to 1.0 acres (Photo 9).
• The West Mine was backfilled and graded between 2000 and 2002.
• Reclamation of the East Mine and Timber Storage Area was accomplished in 2008 and 2009.
• We inspected two resource confirmation drill sites, 2011 -1 (Photo 10) and 2011 -2 (Photo
11), which were approved under MR -127. The sites had been neatly backfilled and graded,
to integrate smoothly with the adjacent, undisturbed lands.
