This sand and gravel pit is owned and operated by Coulson <br /> Excavating Company, Inc. ("Coulson" or "Applicant"). The Applicant shall be responsible for <br /> compliance with this plan. The required fee of $257 for the SWSP has been submitted (receipt <br /> no. 3666878). The Brownwood Pit SWSP was most recently approved on December 31, 2012 <br /> and is valid through October 31, 2014. <br /> Plan Operation <br /> This plan seeks to replace depletions resulting from mining at the Brownwood Gravel <br /> Pit ("Brownwood Pit"). Brownwood Pit is located in the E1/2 of the SE1/4 of Section 19, <br /> Township 5 North, Range 68 West of the 6th P.M. Mining at this site has been completed and <br /> the site is currently undergoing final reclamation. The south east cell has been lined and was <br /> approved as a lined reservoir (WDID 0403398) by the State Engineers Office through a letter <br /> dated October 4, 2012. Renewal of this plan beyond October 2014 was contingent of the <br /> Applicant or its successor in ownership filling an application for a plan for augmentation with <br /> the Division 1 Water Court that includes long-term evaporation losses at the Brownwood Pit or <br /> commenced backfilling of the site. As part of the reclamation efforts Coulson commenced <br /> backfilling the groundwater pond so that the size of the pond was reduced from 13.0 acres to <br /> 12.8 acres. There are no ground water areas within the DRMS permit boundary that were <br /> exposed prior to January 1, 1981. <br /> In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado <br /> Division of Reclamation, Mining, and Safety ("DRMS"), all sand and gravel mining operators <br /> must comply with the requirements of the Colorado Reclamation Act and the Mineral Rules <br /> and Regulations for the protection of water resources. The April 30, 2010 letter from DRMS <br /> requires that you provide information to DRMS to demonstrate you can replace long term <br /> injurious stream depletions that result from mining related exposure of ground water.
