Reclamation of the pit surrounding any disturbed area shall <br />be the responsibility and expense of Vesco and shall be completed pursuant <br />to the Owner's Mined and Reclamation Permit. <br />J. Storm Water. Vesco shall reasonably defend the site from storm water <br />runoff originating from property other than the Owner's by reasonable <br />means, such as berms and dikes and maintenance of the same. <br />K. Records. Vesco shall keep an accurate record of all materials removed <br />from the Lease Premises. The Owner shall have the privilege of examining <br />Vesco's records relating to the Leased Premises during normal business <br />hours. <br />L. Surface Rights. Vesco has the right to clear brush and undergrowth from <br />such portions of the Lease Premises as may be reasonably necessary to <br />explore for material or to locate pits, quarries and stockpile areas. <br />M. Damage to Livestock, Crops and Improvements. Vesco shall repair any <br />damage done to water wells, drinking troughs, storage tanks and other <br />similar improvements on the Leased Premises. Vesco shall pay the <br />reasonable value of any livestock or crops that may be injured, killed, <br />destroyed, or damaged by Vesco or its agents. <br />N. Protection of Premises. Vesco shall install gates and cattle guards at all <br />entrances into the Leased Premises used by Vesco. Said gates will be <br />locked at night and at all times the area is not used by Vesco. <br />8. Owner's Obligations. <br />A. Water. The Owner shall not run water into existing excavation or future <br />excavations located on the Leased Premises unless Vesco has previously <br />agreed in writing that the water would not affect its operation. Any <br />necessary water augmentation shall be the sole responsibility of the Owner <br />and at the Owner's sole expense, and shall be completed in a timely <br />fashion. <br />4 <br />
