The <br />renewal shall take place automatically unless either party notifies the other in <br />writing of its intent to terminate the Lease at least 60 days before the end of the <br />original term. The terms and conditions of the Lease during any additional term <br />shall be the same as under initial Lease, as modified under the provisions of <br />paragraph 3. After the second term of six years Vesco shall have the first right <br />of refusal to match any other offered lease. If there is no other offered lease <br />then the lease may be renewed under the same terms as the previous <br />extension. <br />6. Operator. Vesco is the operator of the aggregate operation on the Lease <br />Premises for purposes of the Colorado Mined Land Reclamation Act (the "Act "). <br />Owner agrees that during the term of this Lease, Owner will not act and Owner <br />will not allow any other person or entity to act as an operator, as defined in the <br />Act. <br />7. Additional Rights and Obligations of Vesco. <br />A. Access. Vesco shall have the right to ingress and egress to the Leased <br />Premises by the route shown on Exhibit A. Vesco agrees to close any <br />gates that it opens. In addition, Vesco may make use of all roadways <br />presently existing on the Leased Premises and may build such additional <br />roads as may be necessary for the production and removal of materials. In <br />building additional roads, Vesco may use materials from the Lease <br />Premises and no payment shall be required for said materials. All roads <br />created by Vesco will be plowed, leveled and seeded with grass. <br />B. Additional Structures. Vesco has the right to erect any temporary <br />structures, such as screening, crushing and asphalt plants; to stockpile <br />material in an area of sufficient size; and to employ any reasonable methods <br />for the removal of said material. All such structures shall be removed from <br />the Leased Premises at the term of the Lease, or within a reasonable time <br />after expiration of the term of this Lease. Vesco has the right to drill water <br />wells on the Lease Premises for use in connection with mining operations. <br />On permanent cessation of the use of any well or termination of the Lease, <br />Vesco shall leave such well and the casing for the Owner, but may remove <br />any pumps or motors. All improvements and equipment placed on the <br />Leased Premises remain Vesco's property. <br />0/ 'n X <br />
