SCHEDULE TO NOTICE OF VIOLATION <br />Notice of Violation No.: CV- 2014 -008 <br />NATURE OF VIOLATION: <br />Failure to provide well abandonment reports within 30 -days. <br />Failure to provide accurate information in well abandonment reports. Inaccuracies include stating wells were <br />sealed to the surface and casings were cut below the ground surface when this was not seen in the field. <br />Failure to cut well casing below surface. <br />Failure to plug and /or seal well casing to within three feet of the ground surface. <br />Failure to temporarily cap and /or seal wells that will be used in the future as required. <br />Failure to construct drill pads as permitted (the pads are larger than permitted). <br />Failure to construct drill pads in location(s) shown on map. <br />Failure to construct light -use roads as permitted (road widths are larger than permitted). <br />Failure to construct light -use roads in location(s) shown on map. <br />Failure to comply with all permit conditions. <br />Failure to provide proper liability for drill pads and light -use roads. <br />ACT, REGULATION, OR PERMIT PROVISION(S) VIOLATED: <br />ACT SECTION(S): Sections 34- 33- 110(2)6); 111(1)(a); 111(1)(e); 113(5) ; and 121(2)(c) <br />REGULATIONSECTION(S): Rules 2.05.3(2)(b) and (c); 2.07.7(6), (7) and (8); 2.10.3(1); 3.02.2(1); 4.07.2; and <br />4.07.3 <br />PERMIT SECTION(S): Permit Pages 2.05 -19 and 20; Drawing 2.05 -M1, Sheet 6 of 6; Exh 2.03 -E3, Part 2- <br />Reclamation Cost Estimate; Exh 2.04 -E3- Geologic Information, Item 9- Borehole <br />Abandonment Information and Methane Drainage Well Information; Exh 2.05- <br />E3, Section 9A <br />PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: <br />CV- 2014 -008 applies to the gob vent boreholes (GVB) and their associated drill pads and light -use roads for <br />longwall panels 9, 11, 15, 18 and 19. Specifically a majority of the longwall panel 18 and 19 pad and road sizes and <br />locations are not correct in the associated exhibits and maps. Additionally, GVB 9 -04, 11 -02, 15 -06, 15 -07 and 16- <br />08 have not been reclaimed in accordance with the applicable Rules and permit commitments. GVB 18 -08, 18 -09 <br />and 19 -09 have not been temporarily sealed in accordance with the applicable Rules and permit commitments. <br />Finally, well abandonment reports have not been submitted in a timely manner (within 60 days of completion). <br />Several abandonment reports for reclaimed wells are missing, including 11 -02 and 16 -05. Well abandonment <br />reports also contain inaccurate information, including indicating that wells were sealed to within three feet of the <br />surface and /or well casings have been cut off below the ground surface, when site inspections have shown this to <br />not be the case. <br />
