remove grasses, forbs, and smaller shrubs and woody plants prior to recovery. The <br />Division has approved incorporation of this vegetative material into the topsoil <br />because it helps provide mulch material within the replaced topsoil and provides a <br />source of indigenous plant propagules to aid in establishment of initial vegetative <br />culture on reclaimed areas. <br />B. The Division has determined selected overburden materials shall be used for, or as <br />a supplement to, topsoil. This variance from the use of topsoil applies to areas at <br />the 5A Portal, old shop, and temporary office area due to their disturbance prior to <br />the Act and the lack of salvaged topsoil at these locations. This determination is <br />based on physical and chemical analyses and field trials approved by the Division. <br />Previously, Stipulation No. 2 had been attached to the permit. This stipulation was <br />complied with upon the submission of Technical Revision No. 8. Details of the <br />overburden analysis may be found in Exhibit 41 (4.06.2(4)(a)). <br />IV. Sealing of Drilled Holes and Underground Openings <br />A detailed description of the sealing of underground openings may be found in Section <br />2.05.4 of the permit with a typical portal seal illustrated in Figure 57. Drill hole sealing <br />may be found in Section 2.05 of the permit. All existing and future drill holes will be <br />sealed in accordance with Rule 4.07. The Mine No. 9 portals were sealed prior to waste <br />material being placed at the No. 9 Mine Portal Excavation. Inspection reports indicate <br />that sealing and initial material storage in the No. 9 Mine Portal Excavation commenced <br />prior to 1991. The Mine No. 5 portals were sealed in 1997 in accordance with Rule <br />4.07.3. The No. 5 portal face -up area was backfilled, sloped and final graded. Mine <br />No. 5A portals were sealed in 2003 in accordance with Rule 4.07.3. Backfill of the <br />Mine No. 5A portals has not occurred at the time of this writing. <br />V. Use of Explosives <br />MCM is not proposing to conduct surface blasting in their mining operation. Should <br />MCM need to conduct surface blasting in the mining operation, the requirements of this <br />section must be addressed and submitted to the Division for approval. <br />VI. Coal Mine Waste Banks <br />The applicant has presented a detailed engineering design for an approximately one - <br />million- cubic -yard coal processing waste pile, also known as the Surface Waste Pile, <br />located within the boundaries of the Williams Fork Mines permit area, as depicted on <br />Permit Map 25. Exhibit 21 of the permit contains a design report for the coal processing <br />waste pile prepared by CTL /Thompson, Inc., and three supplemental documents <br />pertaining to amendments in design details and construction specifications, as well as <br />results of inspection certifications performed by the design engineer. Collectively, these <br />documents represent the amended design for the coal processing waste pile at the <br />Williams Fork Mines complex. <br />Williams Fork Mines 29 Permit Renewal 06 <br />C- 1981 -044 December 8, 2014 <br />
