Northern boundM of <br />Veldman parcel does not appear to reflect new permit boundary after recent acreage release — this will also <br />impact placement of the 200' zone surrounding the permit for surrounding structures in that area This is also <br />the case with the "reclamation plan map" submitted for the Veldman parcel. <br />(b) The name and location of all creeks, roads, buildings, oil and gas wells and lines, and power and <br />communication lines on the area of affected land and within two hundred (200) feet of all boundaries of such <br />area — verify and revise as needed. Power lines mentioned in 3.2.5 of text are not shown on map Item M <br />appears to be greater than 200' from affected area, scale house (Item R) is owned by MMM and does not need <br />to be listed. <br />(c) The existing topography of the area with contour lines of sufficient detail to portray the direction and <br />rate of slope of the affected land — contours not shown on current map C -1 as stated in text, please revise. <br />(d) Show the owner's name, type of structures, and location of all permanent or man -made structures <br />contained on the area of affected land and within two hundred (200) feet of the affected land. — see comment <br />for (b) above. <br />Please delete first sentence in section 3.6 of text — DRMS is requiring monitoring of groundwater levels <br />during mining and reclamation activities. <br />EXHIBIT D - Mining Plan (Rule 6.4.4): <br />The "mining plan map" (D -1) does not show the location of the plant or any of the topsoil or overburden <br />stockpiles for the Ditullio parcel and "phase 2" is not labeled. Please be aware that material cannot be <br />stockpiled in the floodplain without written consent from the floodplain development authority (Larimer <br />County). The permit boundary on the excavation plan and mining limits map for the Veldman Property has <br />not been revised since the recent acreage reduction. The Veldman Map is still labeled as a draft and refers to a <br />legend on another sheet - revise. <br />EXHIBIT E - Reclamation Plan (Rule 6.4.5): <br />The last paragraph of the first page of section 5.1 mentions "contaminated pit run" what is this material <br />"contaminated" with? This statement also applies to the Veldman parcel. <br />It appears that significant portions of the lined reservoirs proposed for this reclamation lie within the floodway <br />and floodplain of the Cache LaPoudre River. Even if Larimer County approves a portion of this area for <br />residential construction, it may be useful to state that the areas of the site that will not be reclaimed as lined <br />reservoirs will be reclaimed as "backfilled and leveled vegetated areas that may later be developed in <br />accordance with applicable Larimer County zoning regulation at some future time" or something to o that <br />effect. This would allow DRMS to release the site as long as the reclamation plan (backfilling and vegetation) <br />had been completed, but not be dependent on the CouM gpproval for or completion of a residential <br />development. <br />There is insufficient information provided for the engineered flood mitigation inlet- outlet structures, or bank <br />armoring for the lined reservoirs within in the floodway areas of the site. Please address how these lined <br />reservoirs will be protected from flood damage, and also comply with floodplain development regulations, <br />given their proximity to the river. DRMS will need design (sizing, capacity, placement, construction) details <br />for the inlet/outlet structures for reservoirs in the floodway. <br />Section 5.1 states that Phase 2 will be reclaimed as an unlined open water pond. DRMS will be required to <br />bond this area for either backfill to two feet above static groundwater or a clay liner until a permanent <br />
