O'BRIAN 303 -423 -7297
PRESIDENT FAX 303 - 423 -7599
November 3, 2014
Washington County
Board of County Commissioners
150 Ash St
Akron, CO 80720
Dear Commissioners;
RE: Franson Pit - Gravel Mine
Attached is a structure agreement letter that Franson Family
Partnership is required to submit to the owners of any structures
within 200 feet of a mining operations. The letter explains the
requirements and the information to assure the owners that the
mine operator ( Franson) will repair or replace any structure that
is damaged by the mining activities. This letter is to explain
why we are sending the Structure Agreement letter to Washington
County.
The mine will be located approximately 1080 feet east of
County Road Aaa in Yuma County but part of the haul route will be
along County Road Aaa. As part of the plan a new access road has
to be built from the county road to the mine. This road will
intersect with County Road Aaa approximately three- quarters of a
mile north of County Road 54 on the east side of Washington
County Road Aaa. No mining will take place within 200 feet of
the road. Yuma County Road and Bridge says that Washington
County maintains the road so it is your county that should have
the Structure Agreement and may also be who we apply to for an
access permit.
Also attached is a notice letter we send to all adjoining
owners. But since we were not aware that Washington County was
associated with the road you did not get one during the notice
