%' <br />' RULE 2 - PERMITS <br />2.01 - GENERAL REQUIREMENTS <br />RULE 2.01.1 - SCOPE <br />Day D.E -ia /// <br />IIIIIIIIIIIIIIIIIII <br />This section establishes the minimum general requirements for permits required to commence or continue <br />surface coal mining and reclamation operations. The objectives of this section are to insure that all persons make <br />timely application for permits, and that all surface coal mining and reclamation operations are conducted only <br />Under permits issued in accordance with the requirements of the Act and these Rules <br />RESPONSE <br />No response is necessary; Twentymile Coal Company (TCC) will comply with the scope of this section. <br />RULE 2.01.2 - GENERAL REQUIREMENTS FOR EXISTING OPERATIONS <br />Not later than two months following the date of approval of the Colorado regulatory ro ram by the <br />Secretary, all operators who are conducti ng and intend to conduct surface coal-iriming coal-mining operations eight months <br />after such approval, shall file an application fora permit with the division for such operations. The application <br />shall comply with all applicable provisions of Rules 2 and 4. With regard to the requirements of 2.05.6 3 b iv <br />the application shall be considered filed if it contains all applicable hydrologic information reasonably available to <br />the applicant as of the date of the application <br />RESPONSE <br />The requirements of this section are not applicable to this permit revision application. See response to <br />Rule 2.01.3. <br />RULE 2.01.3 - GENERAL REQUIREMENTS FOR PERMITS FOR ALL SURFACE COAL MINING <br />AND RECLAMATION OPERATIONS <br />(1) Excepts as provided for in 2 01 3(2) and 2 01 3(5) on and after eight months from the date on <br />which the Colorado regulatory ro ram is a roved by the Secretary of the Interior which date is set forth by Rule <br />of the Board no person shall conduct on lands within this State any surface coal mining and reclamation <br />operations unless such person has first obtained a valid permit issued under the applicable provisions of these <br />Rules. <br />(2) A person conducting surface coal mining and reclamation operations under a permit issued or <br />amended by the Division in accordance with requirements of the "Colorado Mined Land Reclamation Act" <br />(Section 34 -33 -101, C.R.S. 1973) and the Rules and Regulations promulgated therewith and operating in <br />compliance with Section 502 of the Surface Mining Control and Reclamation Act of 1977 (P .L. 95-87), as <br />determined by the Division may conduct these operations beyond the Deriod prescribed in 1 above if- <br />fa) A complete application for a permit has been filed with the Division in accordance with <br />uplicable provision of Rules 2 and 4 and <br />(b) The Division has not vet rendered an initial decision with respect to such application <br />(3) If prior to the date of approval by the Secretary of the Colorado regulatory program, a person has <br />filed with the Division the aPDlication fora permit in compliance with the "Colorado Mined Land Reclamation <br />MR 97 -154 2.01 -1 <br />Revised 10/0 1 /97 <br />
