OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Gen. Compliance With Mine Plan <br />PROBLEM /POSSIBLE VIOLATION: Problem: The Division observed that excavations were not safeguarded from <br />unauthorized entry as necessary for public safety. This is a problem related to Rule 5.3.1(f). <br />CORRECTIVE ACTIONS: The Operator shall adequately safegaurd all excavations by erecting safety fencing <br />around the entire perimeter of all excavations by the corrective action date. Proof of compliance shall be in the <br />form of photographs of the erected safety fencing. <br />CORRECTIVE ACTION DUE DATE: 6/01/15 <br />INSPECTION TOPIC: Gen. Compliance With Mine Plan <br />PROBLEM /POSSIBLE VIOLATION: Problem: Failure to first obtain a reclamation permit from the Mined Land <br />Reclamation Board before engaging in a new mining operation as required by 34- 32.5- 109(1) C.R.S. <br />CORRECTIVE ACTIONS: The Operator shall submit an application for a reclamation permit on or before the <br />corrective action date. <br />CORRECTIVE ACTION DUE DATE: 6/01/15 <br />INSPECTION TOPIC: Sediment Control <br />PROBLEM /POSSIBLE VIOLATION: Problem: The Division observed sediment being transported from the <br />stockpiles into adjacent drainages. This is a problem at this time for failure to protect the affected land from <br />erosion pursuant to C.R.S. 34- 32.5 -116 (4) (j). <br />CORRECTIVE ACTIONS: The operator shall stabilize stockpiles by establishing vegetation or by erecting silt <br />fencing. Proof of compliance shall be in the form of photographs of the stabilized stockpiles. <br />Page 1 of 5 <br />
