COLORADO clik
Division of Water Resources
Department of Natural Resources
1313 Sherman Street, Room 821
Denver, CO 80203
Response to Reclamation Permit Conversion Application Consideration
DATE: December 2, 2014
TO: Peter S. Hays, Environmental Protection Specialist
CC: Division 1 Office, District 64 Water Commissioner
FROM: Sarah Brucker, P.E. RECEIVED
RE: Harms Pit, file No. M-2013-018 DEC 0 2 2014
Operator: Pine Bluffs Gravel Et Excavating, Inc.
Contact: Doug Keller, Project Manager, (307) 245 -3676 RECLAMATION
Section 34, Twp 11 North, Rng 58 West, 6th P.M., Weld County AND SAFETY
CONDITIONS FOR APPROVAL
® The proposed operation does not anticipate exposing groundwater. Therefore, exposure of
ground water must not occur during or after mining operations.
® The applicant has indicated plans to use a very limited amount of water in the mining operation,
to be delivered using the operator's water trucks. Applicant will need to document that this
water was obtained from a legal source or was diverted in priority under a water right decreed
for such industrial use.
COMMENTS: The application seeks to convert M- 2013 -018 from a 110(c) Limited Impact Construction
Materials Permit to a 112(c) Regular Construction Materials Permit. The application also seeks to
increase the permitted area from 9.98 acres to 32.2 acres.
The primary commodities to be mined at the site are sand, gravel, rock, and dirt. The site is proposed to
be reclaimed to grazing/ rangeland upon completion of mining operations.
Mining is proposed to be conducted a minimum of two feet above the groundwater table.
A "very limited" amount of water will be required for mining operations. This water is to be delivered
using the operator's water trucks. The source of this water was not specified.
If stormwater runoff is intercepted by this mining operation and is not diverted or captured in priority, it
must be released to the stream system within 72 hours, which may require a discharge permit from
CDPHE -WQCD. Otherwise, the operator will need to make replacements for evaporation.
Subject to the above conditions, this office has no objection to the proposed mining operation. The
applicant may contact the State Engineer's Office with any questions.
co
HQ ,
1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 555.555.5555 www.water.state.co.us
* IR76 ,
