Volume III, Tab 1 <br />MEMORANDUM OF SURFACE ACCESS AGREEMENT <br />THIS ME ORANDUM OF SURFACE ACCESS AGREEMENT, dated effective the day of <br />(J 2011, is by and between Tamara Burdzinski,1202 Mistwood Ct, Yorkville, IL 60560- <br />1693 (hereinafter referred to as "Tamara'), and Bowie Resources LLC, a Colorado corporation with an <br />address at P.O. Box 1488, Paonia Colorado 81428 (hereinafter referred to as "BRU ). <br />Tamara in consideration of the covenants and agreements contained in tPat certain Surface Access <br />Agreement (the "Agreement") dated effective the 3- day of 2011, granted unto BRL the <br />permission to enter upon and through those certain lands (the "Lan s') belonging to Tamara as further <br />described in Attachment "A" attached hereto and made a part hereof, together with the right to construct, <br />maintain and use on or within the Lands all structures, equipment or facilities Installed on the Lands for <br />the following purposes: (1) to survey, place markers, do future surveying and monitoring of actual or <br />potential surface effects and do the restoration or repair of surface effects resulting from activities of <br />BRL's mining operations; (2) to explore or vent mine gases by installing drill holes and to perform water <br />monitoring with monitoring well located at site(s) mutually agreed to by both Tamara and BRL, such <br />agreement not to be unreasonably withheld; (3) to conduct other activities related to gathering baseline <br />data as may be necessary or required to fulfill all permitting, leasing and reclamation requirements; (4) to <br />perform reclamation or repairs as necessary to any roadways, drill sites or monitoring sites to the <br />standards set forth in any applicable permit or regulation or as agreed to by the parties. <br />Said Lands are subject to all the terms and conditions of the Agreement, reference to which should be <br />made for a complete statement of rights and obligations of Tamara and BRL. Should there be any <br />discrepancy between this Memorandum of Surface Access Agreement and the Agreement, the Agreement <br />shall control. <br />loft <br />
