Rule 2: Permits <br />The Primero Mine portals aze located in the mouth of Smith Canyon near Segundo. This mine extracted <br />six to eight feet ofPrimero Coal using room and pillartechniques with secondary recovery from (902- <br />1925. The portal is located at approximately 6900' MSL and the topographic high in the area is 7200' <br />MSL. There is no evidence of subsidence in the area from reviewing aerial photography. <br />Las Animas County Land Use Classification <br />All lands within the perrrtit area are privately owned. County land use controls which apply to private lands <br />include the Las Animas County Land Development Guide, last updated in 1994. The Guide includes the <br />Comprehensive Plan for the county and the Zoning Regulations. <br />The zoning districts in the county were developed to implement land-use controls that limit the uses ofland <br />in the azea. There aze two zoning districts in the project area: the Agricultural District and the Rural <br />Residential District. ThemajorityofthepermitazeaislocatedintheAgricultura(District. This district <br />protects the productive agricultural lands of the county while preserving the visual and cultural values <br />associated with agricultural lifestyles in nual, unincorporated areas ofLas Animas County, mountains and <br />plains. Underground coal mines and strip mines are a Conditional Use ofthe zoning district, and require <br />a special use permit. <br />The lands along the Purgatoire River and State Highway 12 adjacent to the northern boundary ofthe pemut <br />• area are in the Rural Residential zoning district. This district generally comprises those areas ofthe County <br />along Highway 12 from the Stonewall Valley to Trinidad and on the fringes ofTrinidad which are more <br />conducive to development becauseofthegeneralavailabilityofpublicservicesandfacilities. Underground <br />coal mines are a Conditional Use ofthe zoning district, and require a special use permit. Strip mines are. <br />aprohibiteduseofthedistrict. This application does notproposeminingwithinanyRuralResidential <br />District. <br />2.04.4 CULTURAL AND HISTORIC RESOURCE INFORMATION <br />A listing ofall known cultural resources in areas that wi II be affected by surface activities is included in <br />Ezhibit5. There are no previouslyrecorded cultural resources in the permit area according to current <br />records at the Office of Archaeology and Historic Preservation in Denver. Field work for a cultural <br />resource inventory of about 1765 acres slated for surface impacts has been completed. Ninety-five sites <br />and66isolatedfindshavebeenfoundinthesurveyedportionofthepermi[area. Ninetyofthesitesare <br />prehistoric resources, one is historic, and four have both a historic and prehistoric component. The isolated <br />finds are similarly split between historic and prehistoric resources. At this time, only a single site is <br />recommended to be eligible for inclusion on the National Register of Historic Places. Twenty-seven sites <br />are unevaluated foreligibilitytotheNationalRegister. Theremainderofthesites(67)arerecommended <br />to be not eligible for inclusion on the National Register.
