HBET understands that seepage has been <br />observed along the flanks of the earthen portal plug where no seepage had been previously <br />observed. In addition, HBET understands that the seepage is likely associated with pooled water <br />behind the plug resulting from excess flood irrigation of property above the mine. <br />Field Investigation <br />In order to evaluate the stability of the earthen plug and hazards associated with failure of the <br />plug, HBET conducted a site visit on June 18, 2014. HBET was met at the mine by Tonya <br />Hammond with Snowcap Coal. At the time of our site visit, HBET observed seepage along the <br />edge of the earthen plug at the approximate south flank of the southern portal opening. Ms. <br />Hammond indicated that no seepage had previously been observed in this area. <br />Significant seepage flow was observed at the time of our investigation. However, the water was <br />very clear with no sediment observed. The zone of saturation extended approximately seven feet <br />(vertically) up from the toe of the 2H:1 V flit slope and ten to fifteen feet horizontally from the <br />edge of the fill slope. No evidence of any slumping or other mass earth movement was <br />observed. <br />At the north flank of the northern portal, some limited seepage was observed from below an <br />existing retaining wall. HBET understands that this wall extends back into the fill slope to the <br />approximate edge of the northern portal opening. The seepage in this area was minimal. In <br />addition, no moisture was observed in the fill slopes in this area. <br />
