ENVIRONMENT, INC. <br />NOVEMBER 14, 2014 <br />PAGE 7 <br />6.5 GEOTECHNICAL STABILITY EXHIBIT <br />21) The table of contents and Exhibit D mining plan mentions a geotechnical stability exhibit; <br />however, the permit application as received does not contain the previously mentioned exhibit. <br />Please provide the geotechnical stability exhibit. <br />This was a typo and was committed to prematurely by me when I prepared the application <br />packet. In most cases a Geotechnical Analysis is not needed until an operator.is sure they <br />will not receive all of the Structure Agreements back. As noted above we have prepared 2 <br />analysis, one for the Thornton Reservoir and one for the rest of the sttuctures where no <br />agreement was reached. <br />General Comments and Questions <br />22) Please provide proof of publication in the local newspaper as required by Rule 1.6.5. Proof <br />of publication may consist of either a copy of the last newspaper publication, to include the date <br />published, or a notarized statement from the paper. An application may not be approved until <br />such proof has been obtained. <br />Attached is a copy of the proof of publication. <br />23) As required by Rule 1.6.2(1)(e) please provide proof of mailing or serving all owners of <br />record of the surface and mineral rights of the affected land; and the Owners of Record of all <br />land surface within 200 feet of the boundary of the affected lands. <br />Attached are copies of the return receipt cards from the adjoining owner notices. As noted <br />previously, some of the adjoining owner addresses of record in the Adams County Assessors <br />office were not current and we received 1 of them back for this reason. The other one was <br />one of the landowners that did not retrieve her copy. Copies of the USPS Tracking Reports <br />are provided for the notices that were returned. <br />24) Please address the attached comment from the State Historic Preservation Officer. <br />We wish to thank History Colorado for reviewing our permit. The fish hatchery structures are <br />not on the mine site and are still owned by CPW. This has been a highly disturbed area over <br />the years with the eastern parcel being used for agricultural purposes, the northwest area <br />was an old mine and the south west area was a farm equipment yard.and parking areas <br />used by previous landowners. The portions of the old fish hatchery that are on private land <br />and in Phase 1 that will be mined. The gravel resources under these= abandoned, dilapidate, <br />unmaintained, unlined fish runways is too valuable to leave unmined. They will not be <br />preserved, as is the owners prerogative. The old hatchery buildings are on property that is <br />not part of this reclamation permit. We understand the requirement to contact the local Law <br />enforcement if a body is found during mining. <br />25) Please address the attached comment from Colorado Division of Water Resources. <br />As stated in Exhibit M, a Temporary Substitute Supply Plan and gravel mine well permit will <br />be required. Albert Frei & Sons, inc. is committed to obtaining the necessary permit prior to <br />exposing new groundwater or using groundwater to process material. <br />
