Applicant has requested that certain changes be made to the water rights identified <br />in Paragraph 13, above, to allow such water rights to be utilized in this plan for augmentation. <br />The changes, as approved in this Ruling, are described in Paragraph 27, below. <br />16. The Applicant has also requested that certain conditional rights of exchange be <br />approved and decreed, in connection with the use of its Blue Mesa Reservoir contract water and <br />in connection with the use of its East Beckwith Reservoir No. 1 water. The rights of exchange, <br />as approved in this Ruling, are described in Paragraph 28, below. Applicant has established that <br />water can and will be diverted, stored, and/or otherwise captured, possessed, and controlled and <br />will be beneficially used under such conditional rights of exchange, and that the appropriative <br />rights of exchange can and will be completed with diligence and within a reasonable time. <br />17. The above plan for augmentation, changes of water rights and conditional rights <br />of exchange will not injuriously affect the owner of or persons entitled to use water under a <br />• vested water right or a decreed conditional water right. <br />18. The names and addresses of the owners of land on which the structures involved <br />in the above plan for augmentation are located are as follows: <br />A. The headgate of the Deer Trail Ditch is located on land owned by the <br />United States Bureau of Land Management ("BLM"), Montrose District Office, 2505 S. <br />Townsend Ave., Montrose, CO 81401. <br />B. The headgate of the North Fork Farmer's Ditch is located on land owned <br />by Applicant. <br />C. The East Beckwith Reservoir No. 1 is located on land owned by the <br />United States Forest Service, Paonia Ranger District, P.O. Box 1030, Paonia, CO 81428. The <br />Bowie Sedimentation Ponds are all located on land owned by Applicant or the BLM. <br />D. Blue Mesa Reservoir is located on land owned by the United States of <br />America, Regional Director, Upper Colorado Region, Bureau of Reclamation, 125 South State <br />Street, Room 6107, Salt Lake City, UT 84138-1102. <br />I• <br />
