2.10 <br />Scenic River System (NWSRS). Of the 1.21 miles that are eligible, only <br />0.64 mile is within the LBA tract; 0.76 mile is on private surface and 0.18 <br />mile is on BLM surface. <br />As part of the revision of the UFO RMP (ongoing), the BLM was required <br />by WSRA to inventory its rivers and streams to determine their eligibility <br />for inclusion in the NWSRS. The study and designation of watercourses <br />under the WSRA consists of a multi -step process: eligibility —+ suitability <br />—+ congressional action. In order to be determined as eligible, they must <br />be free - flowing and possess one or more ORV. The West Fork Terror <br />Creek segment is free flowing as defined by the WSRA, and possesses a <br />fish ORV (greenback cutthroat trout - see the Threatened, Endangered <br />and Sensitive Species section). The BLM is currently drafting a suitability <br />report that determines which segments, from among the eligible <br />segments, are suitable for protection under the WSRA. Until that report is <br />finalized, the BLM manages eligible segments under interim protections. <br />Specifically, interim protections include protection of the free -flow of the <br />stream, water quality, and the ORV so as to prevent the segment from <br />losing its eligibility, and to keep the "scenic" classification from degrading <br />to "recreational." (Final Environmental Assessment DOI- BLM- CO -S050- <br />2013 -0010 EA) <br />The West Fork of Terror Creek is not classified as a wild and scenic river <br />and does not fall under Section 5(a) of the Wild and Scenic Rivers Act (16 <br />U.S.C. 1276(a)) <br />(1)(j) The existing topography within the area to be affected during the <br />estimated life of the operation and adjacent lands is shown on two maps. <br />The existing topography of the facilities area is shown on the Premining <br />Topography Map No. 17. The existing topography of the permit and <br />adjacent area is presented on numerous V= 1000' scale maps in the <br />permit application, one of which is the Hydrological Monitoring Location <br />Map No. 9. <br />PR -14 2.10-5- 03/14 <br />
