(5) The potential for impacts to rare and endangered plant species was evaluated as part of the 1995, 2001 and 2003 Baseline Vegetation Reports. No threatened or endangered species were found in the area to be affected by surface operations, facilities or the surrounding area. The DOI- BLM- CO -S050- 2013 -0010 environmental assessment identified Clay Loving wild buckwheat and Colorado hookless cactus as two endangered plant species that may occur in Delta County but restricted distributions are distant and /or habitat is not present in the lease by application area. The EA concludes that no lands within the lease by application review area (COC- 75916) are designated as Critical Habitat, proposed to be designated as Critical Habitat, or determined to be essential habitat for any federally - listed Threatened or Endangered plant or animal species, or species proposed for listing. The 1995 Baseline Vegetation Report identified some wet areas as minor cummunities. Based on a site inspection performed on November 22, 1996 by Randy Snyder with the Corps of Engineers, certain wet areas were identified as wetlands. The wetlands inspected by the Corps are numbered sequentially 1 through 18 on Map 3 - Vegetation. The unnumbered wet areas were not inspected by the Corps, because they are not within the area to be disturbed, however they are assumed to be wetlands. Approximately 0.31 acres of wetlands will be disturbed. The applicant has applied for a Department of the Army Permit for the proposed wetland disturbance which will include a plan to mitigate the wetlands disturbance. The Department of the Army Permit application is presented in Volume III, Exhibit 13, Other Permits. A subsequent inspection performed by the Corps of Engineers (COE) during June 2003, determined two areas previously identified as wetlands were not jurisdictional.
