Operation in violation of section 34- 32.5- 109(1), C.R.S. for failing to obtain a <br />reclamation permit prior to engaging in a new mining operation. <br />6. In addition to imposing a civil penalty against the Operator in the July <br />2014 Order, the Board ordered the Operator to file an application, with all <br />materials in approvable form with the Division, to convert the existing 110c permit <br />to a 112c permit within one hundred and twenty (120) days of the effective date of <br />the July 2014 Order, by October 31, 2014. <br />7. In a letter dated October 20, 2014, the Operator informed the Board <br />that a timely application was submitted in accordance with the July 2014 Order, <br />but the adequacy review required several additional items which the Operator <br />would not be able to complete by the deadline set forward in the July 2014 Order. <br />As such, the Operator requested a 30 -day extension to complete the outstanding <br />issues raised in the adequacy review. <br />8. The Division does not oppose the Operator's extension request. The <br />Division agrees that additional time was needed to resolve the adequacy items <br />before the application can be approved. <br />CONCLUSIONS OF LAW <br />9. The Board has jurisdiction over this matter pursuant to the Colorado <br />Land Reclamation Act for the Extraction of Construction Materials, Article 32.5 of <br />Title 34, C.R.S. (2014). <br />ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Board <br />hereby GRANTS the Operator's request for a thirty (30) day extension to submit all <br />application materials, in an approvable form, to convert the existing 110c permit to <br />a 112c reclamation permit.
