1. The Division received comments from the Colorado Historical Society and Colorado <br /> Division of Water Resources. The letters are attached for your review. Please address the <br /> comments noted in the letters and make any changes in the application as necessary. <br /> PLS Response: Letter from the Colorado Historical Society, regarding Notice of 112 Construction <br /> Materials Reclamation Permit Amendment Application Consideration Pete Lien &Sons,Inc. Owl <br /> Canyon Quarry Permit No. M-1977-302 (SHPO Project#66356) requests that should human <br /> remains be discovered during the proposed project activities, the requirements under State Law <br /> C.R.S. 24-80(part 13) apply and must be followed. PLS will comply with these required laws <br /> should the findings as described be encountered. <br /> The response letter from the Colorado Division of Water Resources provided two conditions for <br /> approval. The first states that exposure to ground water must not occur during or after mining <br /> operations. PLS does not anticipate exposing groundwater and will comply with this condition. <br /> The second condition requires that the groundwater well(WDID 030878,Permit No. 78348-F) is <br /> to only be operated if a substitute water supply plan has been approved by the State Engineer or a <br /> plan for augmentation approved by the water court. PLS is currently operating under an approved <br /> SWSP that was approved by the Division of Water Resources on August 7, 2014 and covers <br /> operations through July 31, 2015. PLS will seek to renew the SWSP for this well when the well is <br /> to be used beyond the July 31, 2015 timeframe. <br /> 6.4.3 Exhibit C—Pre-Mining and Mining Plan Map(s)of Affected Land <br /> 2. As required by rule 6.4.3(c),the Mining Plan Map must show the existing topography of the <br /> area with contour lines of sufficient detail to portray direction and rate of slope. The map <br /> which was submitted for Exhibit C portrays original contours of the area. The map should <br /> depict the site as it currently exists, including all areas of excavation,highwall, and backfilled <br /> areas. The Operator may consider using a larger map scale to portray the necessary detail. <br /> Please revise the Mining Plan Map accordingly. <br /> PLS Response: Please refer to the Mining Annual Report for the 2014 reporting year submitted <br /> earlier this year. The map in this report depicts the most up to date conditions for general <br /> locations, which include all areas of excavation, highwall, backfill, and reclamation. A new <br /> Exhibit C-1 (Current Conditions)site map is enclosed to portray contours of the active mining <br /> areas. Backfilling is currently estimated in mining areas A-1 (BF-II at 95%,A-2(BF-III,IV,19 at <br /> 65%,A-3(BF-VI) at 50%, and active mining in A-4(BF-VIII) at 0%. In general there is a 15 to <br /> 17% downslope to the mining highwall with approximately 50 to 70'height from quarry floor to <br /> the top of highwall. <br /> 3. The Mining Plan Map shows the old railroad line which is no longer present on the site. <br /> Please remove the railroad from the map or add a note which indicates that the railroad <br /> symbol indicates the former location of the railroad. <br /> PLS Response: Please refer to the attached revised Mining Plan Map (Exhibit C).A note has <br /> been added to the maps stating that the old railroad line is no longer present on the site and is <br /> shown as part of the historical topography as the pre-mining conditions on the affected land. <br />
